PLEASE READ CAREFULLY THESE CLUB RULES AND TERMS AND CONDITIONS
As a registered Member referred to as (“Member”) of The Millionaire's Assistant referred to as (“The Millionaire's Assistant/ Company”) you agree to abide by these Terms and Conditions, and
when ordering anything from a supplier of products or services (a “Supplier”) you agree that these Terms and Conditions shall apply to your order.
1. MEMBERSHIP RULES
1.1. All Membership applications are subject to verification by The Millionaire's Assistant. You will be notified in the event that your Membership application has been accepted.
1.2. You are obliged to provide correct details when you apply for The Millionaire's Assistant. Membership and your failure to do so may invalidate your Membership and any subsequent transaction. Your responsibility to provide accurate information is a continuing obligation and you must notify The Millionaire's Assistant in the event that any information provided by you changes. Members shall compensate for any damage which the Company may incur as a result of their failure to submit the details of any change to the Company.
1.3. Your Membership is personal to you. You are responsible for ensuring that no one (other than your personal assistant, where applicable or The Millionaire's Assistant managers) uses your Membership. No Member may assign to a third party any right they have as a Member, let a third party use, sell or purchase, change the name of, pledge or collateralize such right.1.4. Access to and use of the Members section of the The Millionaire's Assistant website ("Site") is through a combination of user name and password and is reserved exclusively for Members. You are solely responsible for maintaining the confidentiality of your user name and password and you agree to notify The Millionaire's Assistant immediately if you believe that there has been any breach of security (e.g. the unauthorized use of your name and password) or if you have forgotten your membership details. No registered name may be
changed unless approved by the Company.
1.5. You agree that you will only use your The Millionaire's Assistant Membership card for the purposes for which it is issued. You must notify The Millionaire's Assistant immediately by e-mail at members@assistantnikki.com if it is lost or stolen.
2. MEMBERSHIP FEES, CANCELLATIONS AND RENEWALS
2.1. Membership fees are communicated upon application. The Joining Fee shall always be deemed to have been paid in the first Membership year. Any increase in Membership fees will be notified through the website or through a personal email.
2.2. Your Membership fee once paid, is non-refundable.
2.3. The Millionaire's Assistant reserves the absolute right to cancel or suspend your Membership (at its sole discretion) if members have falsified input information or used their ID or password in an unauthorized way or if members make payments in arrears or fail to pay or if the members have interfered in the operation of the membership services or badly tarnished the honor of the company. Membership can be cancelled or suspended if the Company deems the Members inappropriate for membership.
2.4. Membership fees are due on acceptance of your Membership application and annually thereafter (“Renewal Date”). Membership fees are payable annually in advance by direct debit or payment by credit/debit or charge card of which we hold the details (“Payment Card”) upon registration.
2.5. You authorize The Millionaire's Assistant to deduct renewal Membership fees by direct debit or any Payment Card up to 28 days prior to or on your Renewal Date. If The Millionaire's Assistant does not hold your payment details you will be contacted directly in order to renew your Membership.
2.6. If you do not wish to renew Membership you must notify us within 30 days of your Renewal Date by telephone, fax or email.
2.7. Those members the Company deems qualified as continuing Members shall have a renewal notification email.
2.8. If a Membership is allowed to lapse for over 30 days, The Millionaire's Assistant reserves the right to recharge the Joining Fee as well as the current Annual Fee in order to renew Membership.
3. MEMBERSHIP BENEFITS
3.1. As a Member of The Millionaire's Assistant, you are entitled to all of the benefits set out on our Site. The descriptions of all benefits displayed have been approved by the relevant benefit Supplier.
3.2. As a registered Member of The Millionaire's Assistant, please note that Suppliers of benefits and the Benefits themselves are subject to availability and may change from time to time without notice.
3.3. The Millionaire's Assistant aims to ensure that the benefits remain available at all times and are constantly negotiating new benefits to ensure that you receive maximum use of your Membership. If any of the benefits become unavailable, we will do all we can to ensure that prior commitments are honored to the fullest extent possible, but shall not be responsible for any actions of suppliers outside The Millionaire's Assistant actual control.
4. USING YOUR MEMBERSHIP
4.1. You may only make requests by telephone, e-mail or through the Site, once you have been accepted as a Member.
4.2. The Millionaire's Assistant will provide or arrange any lawful, proper and moral personal service in relation to any personal needs or desires (including, without limitation, provision of information, access to events, activities and venues, and personal goods and services (the “Services”).
4.3. The Millionaire's Assistant reserves the right to withdraw any of its Services and/or to refuse to supply the Services requested.
4.4. If The Millionaire's Assistant is unable to deal with any request, it will inform you as soon as reasonably practicable.
4.5. Suppliers are responsible for providing you with the services, products and benefits you select. The Millionaire's Assistant will communicate with Suppliers on your behalf.
4.6. Suppliers may impose their own terms and conditions and you are required to comply with these.
4.7. When ordering a product or service or accessing a benefit, you may be required to provide your Payment Card details. If you request and authorize The Millionaire's Assistant to use your Payment Card in order to pay a Supplier for products or services, you acknowledge and agree that The Millionaire's Assistant shall have no liability in respect of or be responsible in any way whatsoever in respect of the use of your Payment Card provided that The Millionaire's Assistant acts in accordance with the instructions issued by you in relation thereto.
4.8. You undertake that all details you provide to us for the purpose of booking, ordering or purchasing products or services are correct, that the Payment Card you are using is your own and that there are sufficient funds to cover the cost of the product or the service.
4.9. From time to time the procurement or provision of certain services, products or benefits may incur a The Millionaire's Assistant handling charge (of which you will be notified) - in these cases you hereby authorize The Millionaire's Assistant to debit your Payment Card with any such handling charges.
4.10. The Millionaire's Assistant may at your order purchase goods or services on your behalf. In the event that it acts as a credit agent in this regard, you hereby authorize The Millionaire's Assistant to deduct the credit sum.
4.11. Unless otherwise agreed by the Supplier, you shall not be entitled to cancel any services requested where, on your instructions, performance has already begun.
4.12. Authorized family members of any registered Member are entitled to use the services.
4.13. Individuals who have been introduced by the Members shall be entitled to sign up.
5. TRAVEL SERVICES
5.1. Any services including travel tickets and package holidays purchased through The Millionaire's Assistant will be subject to the terms and conditions of the travel or holiday operator and the Supplier.
6. RESTAURANT AND CLUB SERVICES
6.1. When you use the restaurant booking Service you hereby authorize us to debit your Payment Card for any deposit paid by us on your behalf to the restaurant which is forfeited as a result of cancellation of the booking.
7. TICKETS
7.1. The Millionaire's Assistant is engaged in the business of obtaining “best tickets” for all sold out events either directly itself or through one of its ticket agent Partners. Please note that you are purchasing tickets above face value, which includes service charge(s) reflecting our costs and efforts in obtaining your premium seats.
7.2. All sales are final, no refunds or cancellations are issued after you have purchased your tickets.
8. RETURNS AND DAMAGED PRODUCTS PURCHASED THROUGH THE SITE
8.1. In case the product was defected, or the Member was not satisfied with the service provided by the third party, The Millionaire's Assistant holds no responsibility for the outsourcer’s failure to satisfy the member and thus we deny any repair, replacement or return.
9. The Millionaire's Assistant CARD
9.1 You confirm that the information given by you when joining The Millionaire's Assistant is true and complete and you authorize us to obtain any credit references and to disclose details of any application or transaction with any credit reference agency or bureau and to make any enquiries you may require to ascertain whether you are entitled to the Platinum credit card. You authorize your bank to respond to such enquiries.
10. CANCELLATION OF RESERVED SERVICES
10.1. Any cancellation of reserved services of restaurants, yacht rentals, private and luxury services and tours shall be charged unless the outsourcer accepted the period of cancellation with no charges given otherwise the Member will be charged fully. We ask our Members full understanding in this regard.
10.2. Members may cancel their orders for services or products if the Company is notified unless orders for periodically-distributed products and the first delivery was made more than one week ago, or if production processes have already started for custom-made items ordered or if orders are not cancellable.
10.3. In case of any change in the member’s reservation date for a service or product specified, the Company shall notify the outsourcer and denies any responsibility for the outsourcer’s loss and thus Members shall pay full charge.
11. CONSIGNMENT
11.1. The Millionaire's Assistant shall consign deliveries and other businesses to its associated delivery companies.
12. INDEMNIFICATION AND LIABILITY
12.1 The Millionaire's Assistant will not be responsible for products and services offered through a direct agreement with service providers or for any problem that arises between the two parties in this case.
12.2. The Millionaire's Assistant accepts no liability for any losses or claims arising from any inability to access the Site or any failure to complete a transaction.
12.3. The Millionaire's Assistant shall have no liability to you for any loss, damage, costs, expenses or other claims for compensation arising from requests or instructions supplied by you which are incomplete, incorrect or inaccurate or arising from their late arrival or non- arrival, or any other fault of you.
12.4. The Millionaire's Assistant disclaims any responsibility during the delivery of products or at a job dispatched place or accidents while traveling in Taxi.
12.5. Members shall make no objection to The Millionaire's Assistant for its failure to provide the services if the company is subject to dispositions by competent authorities of business suspension or revocation of business license or registration or if the company is subject to provisional attachment, provisional disposition or enforcement, or files a petition for public auction as exercise of security right or bankruptcy, or goes into liquidation and if the Company's financial conditions become or threaten with reasonable reasons to become seriously aggravated.
12.6. The Millionaire's Assistant shall not be liable to you or be deemed to be in breach of these terms and Conditions by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the Services, if the delay or failure was due to any cause beyond The Millionaire's Assistant reasonable control.
12.7. The Millionaire's Assistant aims to ensure that viruses (or other programs having adverse effects) do not reside on the Site, but The Millionaire's Assistant accepts no responsibility in relation to this.
13. CHANGES TO THESE TERMS AND CONDITIONS
13.1. The Millionaire's Assistant may revise the Terms at its own judgment without approval of the Members. The Company shall make any revision known to the Members on its website without any delay.
13.2. Any revision of the Terms shall come into force as of the day on which the Company makes such revision public or known.
13.3. Your continued use of your Membership constitutes acceptance of the altered Terms and Conditions.
14. COPYRIGHT
14.1. All copyrights of the contents contained in the Members' magazine produced by the Company or any information posted on the Company's website shall belong to the Company. Unless approved by the Company, no Member may reproduce, transmit, publish, distribute or otherwise use for commercial purposes any information obtained through the Services, nor cause any third party to act likewise.
15. JURISDICTION
15.1. Any problem arising between the Members and The Millionaire's Assistant regarding any use of the Services which may not be settled by the Terms and any rules separately specified by the Company shall be resolved in good faith through mutual consultation by the Members and the Company.
15.2. The Members and the Company consent to the exclusive jurisdiction of the State of California systems with respect to any dispute arising in connection with the Services.
